Boise smoke shops to unite to challenge police, paraphernalia law

BOISE, Idaho (CBS2) — Boise smoke and vape shops plan to band together to form the ‘Smoke Shop Association of Idaho’ to take legal action against the Boise Police Department’s (BPD) recent education and enforcement of state drug paraphernalia law.

“I want to make sure we are compliant, but I don’t want to be bullied by anyone,” said Evan Drake Fischer, owner of Durity Vape stores, after removing what he said was $60,000 in glass products.

He also said he plans to file a restraining order and injunction against the department due to a lack of clarity and documentation. He told officers not to enter his stores without speaking with his lawyers…
