Idaho Judge Probes Gag Order Violation in Kohberger Case

A judge overseeing the quadruple murder trial of Bryan Kohberger is investigating a potential gag order violation. Fourth District Judge Steven Hippler expressed concern that leaked information, featured in an NBC “Dateline” episode, may have compromised the integrity of the case. The leaked information reportedly included details about Kohberger’s internet search history.

Judge Hippler has ordered both the prosecution and defense teams to provide a list of individuals, including staff, law enforcement, and consultants, who had access to the information. He is prepared to appoint a special prosecutor to investigate the leak, which appears to have violated a gag order in place since 2023. The judge emphasized the importance of a fair trial for both sides and the potential impact the leak could have on jury impartiality.

Kohberger, a former Washington State University graduate student, is accused of fatally stabbing four University of Idaho students: Ethan Chapin, Xana Kernodle, Madison Mogen, and Kaylee Goncalves. The students were found dead in an off-campus rental home in Moscow, Idaho, on November 13, 2022.

Kohberger has pleaded not guilty, and the trial is scheduled to begin in August. Prosecutors are seeking the death penalty if he is convicted.

Judge Hippler has also ordered all individuals involved in the case to retain records of communications with journalists and others outside law enforcement regarding Kohberger or the investigation. The judge noted that the potential leak prompted him to add alternate jurors to the trial. He has requested a formal investigation into the matter from the legal teams.

In other developments, Judge Hippler ruled last week that Kohberger’s immediate family can attend the trial, even if called to testify. Family members of the victims are also permitted to attend. Steve Goncalves, father of Kaylee Goncalves, previously shared his belief that his daughter had woken up during the attack and tried to escape.
