Family of 3-year-old boy who drowned in Palm Harbor plans to sue apartment complex

PALM HARBOR, Fla. (WFLA) — The family of 3-year-old Kyrie Larry, a boy with autism who drowned in a retention pond behind their Palm Harbor apartment in April, spoke publicly for the first time and is taking legal action.

At a press conference held Thursday, Kyrie’s parents, Marcus Larry and Jasmine Torrence, stood alongside their attorneys and an ASL interpreter to announce plans to file a wrongful death lawsuit against the Lansbrook Village apartment complex, where the incident happened.

“I don’t know if anybody can understand clearly the struggles and the pain that we face through this loss of our son,” said Marcus Larry, speaking through Autumn Samuels, an ASL interpreter.

The lawsuit claims the retention pond behind the family’s East Lake Road home was unsafe with a dangerously steep slope and no fence, both of which violate state and local safety codes, according to the family’s attorneys.

“We intend to hold this apartment complex liable and responsible for Kyrie’s death,” said Pedro Echarte, an attorney with The Haggard Law Firm. “And in doing so, we intend to send a message to other apartment complexes and property owners that they need to comply with governing safety regulations.”…
