Man sentenced for homicide near a homeless shelter

ALBUQUERQUE, N.M. — The Albuquerque man who admitted to a 2024 murder, outside of a homeless shelter, will now spend more than eight years in prison.

In 2024, Jose Gracia lunged out of his wheelchair and killed Mark Lavine outside of the Hopeworks shelter. Gracia pleaded guilty to second-degree murder. In a statement shared through his lawyer, Gracia said he was sorry and said he didn’t mean to kill Lavine.
