New Mandate for Airbnb Managers

According to the NC Department of Labor (NCDOL), NC General Statutes 130A-511 and 42A-39 apply to property managers, “lodging establishment employees and their third-party contractors who perform housekeeping services, provide food or beverage services, or perform check-in and check-out duties, and accommodation facilitators.”

Training, which is to recur biannually, must be approved by the NCDOL “in collaboration with the North Carolina Department of Health and Human Services, the North Carolina Restaurant and Lodging Association, and the Human Trafficking Commission (NCHTC).” Training is free, but evading it comes with stiff penalties ranging from $500-$2000. Falsifying training credentials will constitute an unfair trade practice and “significantly” escalate penalties.

Then, there are reporting and record-keeping requirements. Each lodging facility is to keep a log of who took which human trafficking awareness classes, when. Then, lodging facilities are to post “human trafficking awareness signage” and a NCHTC poster. The legislation also requires that facilities develop their own, written procedures for reporting suspected human trafficking. So, hopefully the training will help with positive identifications…
