Fired Noble County Athletic Director Suing School District

KENDALLVILLE — An ex-athletic director in Noble County, previously charged with theft and official misconduct, is suing members of his school district for not informing him of his Garrity rights, which allows self-incrimination to be avoided by public employees in internal investigations.

Nicholas David, who was hired as athletic director in 2014, said his former employer, East Noble School Corporation, and three district councillors, did not investigate him using legitimate procedures. As a result, David was forced to speak without seeking legal counsel or fully considering his rights.

David was charged and arrested last fall for the theft of $750 to $50,000 dollars and misconduct as a public official…
