Woman charged with Rucker Circle shooting wants to make self-defense argument

HUNTSVILLE, Ala. (WHNT) — A woman charged with murder in a June 16 shooting on Rucker Circle is arguing she acted in self-defense, but it is not clear when she will be allowed to make that argument in court.Amber Baker, 25, is charged with killing Nicholas Howell.

Baker’s attorneys have asked a Madison County District Court judge to schedule an immunity hearing. The hearing would allow her to provide evidence that she was legally justified in the shooting because she acted in self-defense. If she were successful in making that argument, she would be immune from prosecution.

But in Alabama generally, immunity hearings are heard by the trial judge in Circuit Court, not judges in District Court, who handle the preliminary stages of a criminal case.

Baker’s attorney, Larry Marsili, made a similar argument on behalf of Jeremiah Matkins, who is also arguing he acted in self-defense in the Twin Peaks deadly shooting last November…
