LEXINGTON, Ky. (FOX 56) — Lexington home and business owners have filed suit against the Fayette County Board of Education, claiming the district purchased, developed, and even encroached on land it didn’t own due to an exemption from being subjected to local land use laws.
In the lawsuit, Attorney Bruce Simpson, who represents homeowners Theresa Leito and Kristofer Zander, wrote that in October 2024, the board of education bought land at the 1600 block of Versailles Road for $10 million, destroying a “substantial urban forest” and a historic home.

When the homeowners asked district representatives about the development project, they were allegedly met with vague answers that left Leito and Zander “bewildered” about what was about to allegedly unfold.
Shortly after construction began, the district was sent a cease-and-desist directive from Zander and Leito, saying that a portion of the driveway in the area that belonged to a single-family home was torn down to create a bus route, which became used by large construction vehicles.

This construction has allegedly caused Leito’s home to be uninhabitable due to the effects of the bus route traffic, “gutting” her aspirations and more than $77,000 she had spent in improvement projects to create her “forever home,” per the lawsuit…
