CABARRUS COUNTY, N.C. — It’s been about nine months since WCNC Charlotte first shared that the family of a Cabarrus County student spoke out and said a now-former teacher reportedly choked and sat on him. Now, we’ve learned the family is suing Cabarrus County Schools.
The lawsuit was filed in Cabarrus County’s Superior Court on Tuesday. Chris Mason’s family claims the district was negligent in ensuring Mason’s unique needs and that the former teacher violated his rights, committed battery, discriminated against him under the Americans with Disabilities Act, inflicted emotional distress, and failed to protect Mason from physical and emotional harm.
According to the suit, Mason’s family seeks punitive and compensatory damages exceeding $25,000, medical expenses, and attorney fees and court costs paid by the district. They want the case heard before a jury trial as well…
