BIRMINGHAM, Ala. — The Alabama Department of Human Resources has filed a motion to dismiss a wrongful death lawsuit following the death of 3-year-old Ke’torrius “KJ” Starkes Jr., who was left in a hot car in Birmingham in July.
The lawsuit, filed by the child’s family, alleges that Kela Stanford left KJ in the car for five hours. Stanford was employed by Covenant Services Inc. and contracted through DHR.
According to the family’s attorney, DHR is seeking dismissal of the wrongful death claims, citing state-agent immunity for several defendants named in the suit. The employee responsible for transporting KJ denies any negligence…
