Schenectady man sentenced for driving drunk with an illegal firearm

ALBANY — A Schenectady man was sentenced to five and a half years in prison on Thursday after pleading guilty to driving drunk, crashing into a tree, and possessing an illegal handgun, according to the Albany County District Attorney’s office.

Mario Malcolm, 30, was sentenced by Albany County Judge Andra Ackerman to serve five and a half years in prison followed by five years of post-release supervision. He pleaded guilty to attempted criminal possession of a weapon in the second degree and driving while intoxicated.

The charges stem from an Aug. 3, 2024 incident in Colonie. Early that morning, police responded to a single-vehicle crash near Albany Street and Virginia Avenue, where they found a car that had struck a tree.

Officers discovered Malcolm passed out in the driver’s seat. A loaded 9mm handgun, which police said had an illegal ammunition clip, was found under his leg. He did not have a permit for the weapon…
