City of Lake Oswego, resident and homeowners association face lawsuit over death during 2024 winter storm

Lawsuit claims parties were negligent for not removing or allowing removal of tree

An estate representative of the Lake Oswego man who died after a tree fell on his home during the January 2024 winter storm filed an $8.5 million lawsuit against a neighbor, the city of Lake Oswego and the Meadowcreeks at Westwood Homeowners Association this week.

On Jan. 13, 2024, a tree fell through the home of Frank George Ness. Jr. at Sunbrook Drive. The tree came from the property of his neighbor, Christopher E. Klock. During the storm that month, hundreds of trees in the community fell onto public and private property — leading to massive cleanup efforts and questions surrounding the city’s permitting standards for tree removals.
