Lawsuit filed against New Hanover County Clerk of Court for withholding public records

WILMINGTON, N.C. (WECT) – The American Civil Liberties Union of North Carolina Foundation (ACLU-NC) has filed a lawsuit against the New Hanover County Clerk of Superior Court for allegedly withholding public records.

In a press release, ACLU-NC claims that it contacted the New Hanover Clerk of Court multiple times about criminal cases involving people found “Incapable to Proceed” (ITP) due to mental health concerns or cognitive disabilities.

According to the ACLU-NC, court clerks are required by law to maintain ITP records. Additionally, the NC Public Records Act stipulates that ITP records must be made available to the public upon request…
