ALBANY, N.Y. (NEWS10) — On Wednesday a grand jury indicted Lorenz Kraus, the man accused of murdering his parents and burying the bodies in the backyard. The case is now being moved to Albany County court. In an exclusive interview with NEWS10’s James De La Fuente a panelist from the grand jury that indicted Kraus shared what it was like to be there for the proceedings, and a lawyer explained more about the TV confession that shocked the Capital Region.

“How could somebody do this to their parents?” questioned the panelist. “I couldn’t believe that they had gotten away with it for eight years and nobody reported it or noticed.”
The juror said the decision to indict Kraus came swiftly, “It did not take time. It was like the quickest case we had.” The juror said they had not seen Kraus’ TV confession but said in their opinion, “an indictment was necessary”.
George LaMarche, Partner Attorney with LaMarche Safranko Law who is not associated with this case explained that Kraus’ televised confession will be admissible in court. “He was not at a police station. It was ordered to be there. He wasn’t in handcuffs. There was no pressure to give his statement. And for those reasons, it appears to be completely voluntary and therefore will be able to be used against him at a trial.”

The attorney said the defense could challenge the confession, “Is there some argument that they could make about why that confession could be suppressed, which is the key piece of evidence in this case. Is there some psychiatric defense or extreme emotional disturbance defense that the defense could assert to try to mitigate or minimize the outcome of the case?”…
