Albuquerque man sentenced for brutal attack inside a McDonald’s

ALBUQUERQUE, N.M. (KRQE) – An Albuquerque man who brutally beat another man in a fast-food restaurant was in court for a sentencing hearing Wednesday. Judge Britt Baca ordered Heath Miller to serve two years in prison, after he previously pleaded no contest to aggravated battery resulting in great bodily harm.

Video shows Miller and Timothy Jerome Roberts talking inside the McDonald’s at Central and Yale in June of 2024. The video goes on to show Miller hitting Roberts and then repeatedly striking him as he lay on the ground. Roberts suffered severe injuries from the attack and was in a coma as a result. Roberts’ family says he still suffers from a severe brain injury from the attack. As part of the plea agreement, Miller faced at most two years behind bars.
