One former prison guard found guilty of murder, two acquitted, in Robert Brooks’ death

UTICA, N.Y. — One former prison guard has been found guilty of murder and two have been acquitted in the death of Robert Brooks, the Greece man who was beaten at Marcy Correctional Facility.

The jury read the verdict on Monday around 10:15 a.m. in Oneida County Court. Jurors found former guard David Kingsley guilty of both second-degree murder and manslaughter. For the other two, Nicholas Kieffer and Matthew Galliher, jurors found them not guilty on murder, manslaughter, and gang assault. In addition, Kieffer was found not guilty of offering a false instrument for filing.

Monday marked the third full day of deliberations. Bodycam video showed several corrections officers beating Brooks, an inmate, in a medical exam room in December at Marcy Correctional Facility.
