A Prairie City man who faced a class D felony theft charge for selling a stolen cellphone was sentenced Tuesday on a reduced serious misdemeanor offense. On August 19th, Prairie City Police say twenty-four-year-old Dallas Scott Smithart sold a cellphone stolen from an Ottumwa woman at Bison Park. The phone was sold at a kiosk at the Newton Walmart. Smithart was originally charged with 2nd degree theft, but pleaded guilty to a reduced charge of 4th degree theft. District Associate Judge Steven Holwerda accepted the plea agreement, and sentenced Smithart to one year of probation and a $430 civil penalty.
