TULSA COUNTY, Okla. — A motion to disqualify Tulsa County District Attorney Steve Kunzweiler and the Tulsa County District Attorney’s Office has been filed in the case of the State of Oklahoma v. April Wilkens.
The motion was filed on Monday and requests that DA Steve Kunzweiler, Assistant DA Meghan Hilborn, and the Tulsa County District Attorney’s Office be removed from any “further participation” in the case against Wilkens.
The motion also requests that a court appoint a substitute prosecutor from outside of Tulsa County, citing 22 O.S. § 859, or request that the Oklahoma Attorney General’s Office take over the case, as outlined in 74 O.S. § 18.b(A)(1).
“…Mr. Kunzweiler’s office is compromised by serious conflicts of interest that undermine the Defendant’s due process right to a fair and impartial process,” reads the court document. “This motion will set forth the facts as currently known to undersigned counsel, followed by points and authorities to guide the Court in its consideration of the matter.”…
