UTEP professor Max Grossman’s domestic violence case set to be dismissed

EL PASO, Texas (KTSM) — The case of UTEP’s associate professor and prominent community activist Max Grossman, who was arrested back in September in connection with a domestic incident, is expected to be dismissed in 48 hours, according to Grossman’s attorney, Brian Kennedy.

Records show that Grossman was granted a pre-trial deferment, a voluntary program aimed at preventing a criminal conviction. This decision came after the El Paso District Attorney’s Office, led by James Montoya, chose not to move forward with prosecution.

The DA’s office explained that Grossman was referred to the pre-trial diversion program after reviewing the details of the case, including the available evidence and his clean criminal record. “The decision to offer diversion was based on a comprehensive evaluation of the facts and circumstances surrounding the case,” the office said in a statement. “As part of the diversion, Grossman must comply with the conditions of his bond, avoid alcohol or drug use, refrain from committing new offenses, pay a supervision fee, and complete prescribed classes.”

Kennedy confirmed that Grossman had completed victim impact classes and is expected to have his record partially expunged, though he will need to waive certain rights to prevent future diversions…
