Lawsuit claims Penn Square Mall owner using illegal tactics to block new retailers from opening at neighboring OAK

OKLAHOMA CITY (KFOR) — The owners of OAK, an upscale outdoor shopping center across from Penn Square Mall, filed a federal lawsuit this week accusing Penn Square’s corporate owners of using illegal antitrust tactics to keep major restaurants and retailers out of the Oklahoma City market unless they agree to open inside Penn Square.

OAK is a mixed-use retail and dining development that opened last year after local developers began planning it in 2016.

The lawsuit claims Indiana-based Simon Property Group, which owns Penn Square Mall and nearly 200 other malls nationwide, has been using its national retail market influence to coerce retailers into opening at Penn Square, or nowhere in Oklahoma at all…
