Troy man with six prior felonies sentenced for illegal weapon possession

East Greenbush, NY (WRGB) — A Troy man with multiple prior felony convictions has been sentenced to 14 years in state prison for illegally possessing what authorities are saying a loaded assault weapon in East Greenbush.

Rensselaer County District Attorney Mary Pat Donnelly announced Friday that Kenneth Phelan was sentenced before Hon. Debra J. Young following his guilty plea to the full indictment, which included:

  • Criminal Possession of a Weapon in the Second Degree, Class C violent felony
  • Criminal Possession of a Weapon in the Third Degree – Assault Weapon, Class D violent felony
  • Criminal Possession of a Weapon in the Third Degree – High-Capacity Magazine, Class D violent felony

Phelan was arrested on November 11, 2024 after East Greenbush Police responded to River Road for a report of a confrontation between Phelan and a property owner over Phelan target shooting on the property without permission. Officers took him into custody after discovering he had an unserialized rifle loaded with what authorities say a high-capacity magazine and military-grade ammunition.
