Sale of damaged Dry Creek Ranch home spawns web of lawsuits between Boise Hunter Homes, realtor, contractors and former owners

The question of who is at fault for damage to a home’s foundation is at the heart of a sprawling legal battle involving the developers of Dry Creek Ranch, current and former residents, contractors, and an Eagle realtor.

In January 2025, Dry Creek Ranch resident Alicia Carinalli filed a lawsuit against Boise Hunter Homes and the former owners of her home, Michael and Teena Pojar, alleging fraud and violations of other state codes governing the disclosure and condition of the home she bought in the planned community two and a half years ago. Her suit sought damages for at least $400,000 and attorneys’ fees due to allegations BHH “built a home with substantial defects” to the foundation and the Pojars sold it to her for more than $800,000 without properly disclosing the problems.

In legal filings, the Pojars say they were told by BHH and their realtor, Mark Fitzpatrick, not to disclose an engineering report detailing concerns with cracking in the home…
