A psychologist told Wilson County Superior Court judge on Tuesday that she is not optimistic that arson defendant Eric Malloy will be able to regain the mental capacity to proceed to trial.
Malloy, 41, of Angier is charged with felony first-degree arson and numerous other charges in connection with the burning of a Raleigh Road home on Sept. 25, 2022.
While awaiting trial on the charges in the Wilson County Detention Center on Jan. 15, 2023, Malloy ingested and overdosed on a combination of contraband prescription medicine and opioids.
