Broadview Heights Nursing Home Sued for Wrongful Death Over Alleged Negligence and Poor Care of 72-Year-Old Resident

The distressing story of 72-year-old Charles Brush, who lived out his last days in what has been described as “deplorable conditions” at a Broadview Heights nursing home, is now at the center of a wrongful death lawsuit filed by his family. Brush’s daughters, Jennifer and Heather Brush, have stepped forward with serious allegations of medical negligence leading up to their father’s death in March 2025. The family claims that the Avenue at Broadview Heights Care and Rehabilitation Center failed to address a severe Candida auris infection, which Brush had contracted during his residency.

According to a statement obtained by Cleveland19, one of the daughters described finding her father in a freezing, 52-degree room, huddled and shaking. This was only days before he was hurried to the hospital with a low body temperature indicative of severe hypothermia. In an alarming voicemail left for his daughter, Brush himself expressed worry, saying, “Yesterday they kept me in isolation for I don’t know why. Now they’re doing it again to me. I didn’t eat yesterday. I didn’t eat, probably not eating today.”

The lawsuit alleges that the staff at the facility not only neglected to treat the yeast infection but also failed to maintain a clean environment for Brush. In an interview given by the family attorney, Michael Hill, to Law&Crime, it was mentioned that feces and urine were found in Brush’s room and even on personal items like a toothbrush. At a hospital, Brush’s condition rapidly deteriorated, ultimately leading to his death, which the coroner attributed to heart disease complicated by pneumonia…
