Motion granted to delay federal trial for man tied to Kentucky overdose deaths

LEXINGTON, Ky. (FOX 56) — A federal judge has granted Brian Epperson’s motion to delay his trial by 90 days.

Epperson’s defense filed the motion on Jan. 12, seeking at least a three-month delay. On Oct. 16, 2025, he pleaded not guilty to a federal indictment linking him to the deaths of two women in May and July 2025.

His trial had been scheduled for Feb. 2 under the Speedy Trial Act, which requires a criminal trial to begin within 70 days of the indictment, according to court documents. Epperson was arraigned on Nov. 24, 2025, meeting the 70-day requirement.

In court documents, Epperson’s defense said the extra time is needed to “adequately review and analyze the discovery to ensure proper trial preparation.” The defense added that the delay would allow Epperson to make informed decisions regarding his case…
