BATON ROUGE, La. (WAFB) – A motions hearing was held Wednesday for Desmond Carter, one of the men accused in the rape of LSU student Madison Brooks before her death in January 2023.
Carter, 19, appeared before Judge Gail Ray as his defense team sought to have charges dismissed through several pending motions. The defendant faces first-degree rape and third-degree rape charges in connection with the incident that occurred Jan. 15, 2023.
Outstanding motions challenge case
Three motions remain before the court: a motion to quash the indictment as a violation of double jeopardy, a motion to quash count one in the indictment, and a motion for confidential viewing of evidence deemed contraband.
The motion to quash will not be heard immediately since it was filed Friday. State law requires that when a defendant alleges a statute is unconstitutional, the Attorney General must be notified and allowed an opportunity to respond or intervene. This notification has not yet occurred…
