Lawsuit over in-home business in Two Rivers HOA ends in homeowner paying $20,000 in attorneys fees

An Eagle couple had to pay thousands in attorneys’ fees at the end of a two-year legal battle over their in-home business.

Last week, the final paperwork closing a lawsuit between Two Rivers Subdivision HOA and residents Yuriy Buchinskiy and his wife, Valentina Buchinskiy, ordered the homeowners to pay $20,000 in attorneys’ fees. This closes the dispute that began at the end of 2023 when the HOA filed suit against the Buchinskiys, aiming to force them to stop operating their small businesses out of their home in the upscale subdivision. The HOA said they violated the CC&Rs that block any businesses from operating in Two Rivers to keep the area specifically for residents and their visitors, not business traffic.

As BoiseDev reported, Judge Derrick O’Neill ruled largely in favor of the Two Rivers HOA last year and later put a permanent injunction in place blocking Valentina Buchinskiy from operating her clothing alteration business, or any similar business, out of her home in the neighborhood in June 2024. Last week’s judgment order reiterated that this injunction will remain in place, and a counterclaim from the Buchinkskiys against the HOA over the neighborhood’s decision to rent its clubhouse remains dismissed…
