Student cyclist at fault, MCPS bus driver cited in fatal Rockville collision, police say

The driver of the Montgomery County Public Schools (MCPS) bus that struck and killed 11-year-old Summer Lim on Oct. 9 in Rockville was cited with one count of negligent driving contributing to a fatal accident, county police said Friday in a statement.

A police investigation found the bus was in the intersection of Russet Road and Bauer Drive near Earle B. Wood Middle School that afternoon when Summer rode her bicycle into the crosswalk and was struck by the vehicle, according to the statement. The bus driver, Ivan Rivas, 55, allegedly stopped after the impact, then moved the bus nearly 30 feet before coming to a complete stop.

Detectives “determined that Lim was at fault in the collision for entering the crosswalk while the bus was already occupying the intersection,” but that Rivas was also allegedly negligent for moving the bus forward after coming to a complete stop, the statement said…
