This week, the Marietta City Council approved a settlement in a lawsuit alleging the city took property without compensation when building Elizabeth Porter Park.
The council voted 6-0, with Councilman Carlyle Kent absent, to approve a settlement for a lawsuit filed in 2020 by Ray Summerour.
The settlement includes the city purchasing Summerour’s property at 329 Allgood Road for $520,000 and attorneys fees, subject to final revision by the city attorney…
