(WLUK) — The village of Hobart filed an appeal this week in Chicago federal court, challenging a ruling permitting the Oneida Nation to place land into trust status.
The Department of Interior granted the Oneida Nation’s application to have eight properties totaling 499 acres placed in trust for the tribe. Such actions take the lots off the property tax rolls, which is why the village objects to the move. In December, a federal judge upheld the decision.
The village has argued its due process rights were violated, and it also challenges the constitutionality of the Indian Reorganization Act. Its full brief for the appeal is due next month, court records show…
