Staff at Upstate NY pub continued closing duties while an unconscious customer slowly died, then lied about it (police)

Three people face felony charges after an investigation revealed staff at an Upstate New York pub delayed calling emergency services for a patron who suffered a fatal head injury and attempted to make it appear he had been found outside the establishment.

John Acito, 68, died Jan. 1, 2026, from complications of blunt force head injuries sustained at Dave’s Long Pond Pub in Rochester on Dec. 17, 2025, according to the Monroe County Medical Examiner’s Office, which ruled his death accidental.

Greece (N.Y.) Police responded to the pub on Dec. 17 for a report of an unresponsive male. Staff initially told officers Acito had been located outside in the parking lot before being brought inside. He was transported to Strong Memorial Hospital with a significant head injury and remained in a coma until his death…
