Fayetteville enters mediation after lawsuit over fire station dismissed

The city of Fayetteville has announced that its lawsuit against Fire Station No. 4 contractor W.B. Brawley is headed to mediation following last week’s dismissal of the case.

The city sued contractor W.B. Brawley on Sept. 25, 2024, claiming the company repeatedly performed defective work on Fire Station No. 4 and refused to correct it, the Observer previously reported. The city also sued Travelers Casualty and Surety Company of America for allegedly breaching its bond obligations. W.B. Brawley filed a countersuit in October 2024, denying responsibility for the alleged defects. It placed the blame on design and inspection failures and project management decisions made by the city and its architect.

On Feb. 13, all parties agreed to dismiss the case and participate in mediation, according to court documents. The dismissal follows recent court rulings denying special case status and a trial delay…
