MEMPHIS, Tenn. (WMC) – The prosecutor involved in a lawsuit by a Memphis man who was wrongfully arrested because of a name misspelling has been dismissed from the suit.
Gavin Smith, a prosecutor in the case, is no longer involved in the lawsuit.
The judge ruled that county prosecutors had immunity, saying “it can protect a prosecutor’s illegal and improper conduct—even when that conduct genuinely wrongs a defendant…”…
