Local developer sues City of Aiken over disputed sewer agreement

AIKEN, S.C. (WRDW/WAGT) – A local developer has sued the City of Aiken, seeking more than $40 million in damages and alleging the city backed away from a sewer agreement tied to a planned residential development.

Crowell & Company, Inc. said it filed the lawsuit after the city informed the developer in late 2025 that it would need to reapply for sewer access to its Toolebeck Road property, the site of a proposed 247-unit project.

Crowell said the city took the position that a recorded 2020 utility service agreement allowing sewer service was subject to a two-year limitation. Crowell disputes that interpretation, saying the recorded agreement contains no expiration date and does not reference a two-year term…
