Mobile murder defendant’s lawyer says key evidence hasn’t been turned over

MOBILE, Ala. (WALA) – With a trial date quickly approaching, the lawyer for a murder defendant is seeking sanctions against the state for failure to turn over key evidence.

Prosecutors allege that DeAngelo Demetrius Merrill, 33, kicked in the door of a home at Pathway Place Apartments near Florida Street in 2021 and shot a disabled Army veteran. Investigators contend that Merrill was seeking revenge for the shooting of his girlfriend earlier that day but that he went to the wrong apartment by mistake.

Trial is scheduled for April 6. Defense attorney Christine Hernandez said the Mobile County District Attorney’s Office turned over material in its possession but that she has not received several items that the Mobile Police Department has, including firearms reports, cell phone records, photos and recorded interviews with two witnesses…
