With all due respect to my colleague Fred Herman, he misses the point. Billboards, radio spots and TV ads for plaintiffs’ lawyers all tout “big paydays” of the millions that lawyers have obtained for their clients.
These ads have desensitized jurors to the value of a dollar, driving nuclear verdicts, such that it’s nothing for jurors to make disproportionate awards. I’ve seen this personally as a defense attorney. That said, as someone who does plaintiff work too, I have no problem with just compensation, just not because a TV lawyer says what that award should be.
