Real Housewives of Atlanta newcomer Pinky Cole is fighting back in court after a creditor reportedly seized her Georgia home while she was already in the middle of a bankruptcy proceeding. Court documents reveal the situation escalated quickly, with the Slutty Vegan founder rushing to file an emergency motion to address what she describes as an unlawful takeover of her property.
According to the filings, Cole owns a six-bedroom, four-bathroom home spanning 2,814 square feet in Loganville, Ga., a city located roughly an hour east of Atlanta. The property sits at the center of her legal dispute with Guardian Asset Management, the creditor she says entered the home, posted a notice in the street-facing window, and changed the locks without authorization.
Why Cole says the seizure was illegal
The timing of the alleged seizure is central to Cole’s argument. She filed for Chapter 11 bankruptcy earlier this year, and under bankruptcy law, that filing triggers what is known as an automatic stay, which generally pauses all collection actions against the debtor’s assets. Cole’s legal team reportedly contacted Guardian Asset Management after the seizure to make clear that its actions were improper under that protection.
The creditor has not yet formally responded to the court filing. Cole is asking the court to intervene and restore access to the property.
