12-year sentence handed down in Tops ghost gun case

BUFFALO, N.Y. (WIVB) — One of the two men involved in a gun-related incident at the Tops grocery store on Jefferson Avenue in Buffalo last year was sentenced Tuesday to 12 years in prison.

Avello Pena, 35, of Tonawanda, will also serve five years of probation.

The June 17 incident reopened wounds for some residents because it happened at the same store where a Broome County teenager fatally shot 10 Black people and injured three others in May 2022. Prosecutors said that shooting was motivated by white supremacist beliefs…
