Malloy found incapable of standing trial

The defendant in a 2022 arson case was found to be incapable of proceeding to trial and “unrestorable” last week in Wilson Criminal Superior Court.

Eric Leith Malloy, 41, of Angier had been charged with felony first-degree arson, felony burning certain buildings, felony breaking and entering, felony larceny after breaking and entering, felony possession of a stolen vehicle, felony attempted larceny, felony financial card theft and two counts of burning caused during commission of a felony in connection with a Sept. 25, 2022, break-in and fire that resulted in the destruction of a home at 705 Raleigh Road Parkway and the death of a cat.

The Times has previously reported that on Jan. 15, 2024, while incarcerated and awaiting trial, Malloy became comatose after ingesting a combination of prescription medications and opioids that had been smuggled into the Wilson County Detention Center by an inmate.
