In 2021, the owner hoped to sell the building to Home Depot
Lumberjack L.P, the owner of the 159,000 square-foot building that used to be a Fry’s Electronics store at 29400 Town Center Loop West, is suing the city of Wilsonville, alleging that its property restrictions and actions have made it nearly impossible for the company to sell or utilize the space.
The complaint, filed on March 20 in the United States District Court, District of Oregon, alleges that the city is violating the company’s Fifth and Fourteenth Amendment rights, as well as the Oregon Constitution, by “taking the property without payment of just compensation.”
“Lumberjack is continuing to expend millions in carrying costs such as insurance, taxes, and maintenance. And because Lumberjack has no economically beneficial uses of the Property, Lumberjack has been forced to spend substantial sums to secure the Property and prevent it from becoming blighted. Despite this, the City has cited Lumberjack for nuisance violations based on the actions of third parties who vandalized the Property,” the complaint said…
