NY AG: Charges Unlikely from Fatal Officer-Involved Shooting in Mina

It does not appear there will be any charges filed in connection with a fatal officer-involved shooting that took place last year in the Town of Mina. According to a Notification of Investigative Findings issued by New York Attorney General Letitia James’ Office of Special Investigation (OSI), a prosecutor would not be able to disprove beyond a reasonable doubt that the use of deadly physical force against 66-year-old Mark Bemis was justified under the law. Chautauqua County Sheriff’s deputies fatally shot Bemis after responding to a 911 call for a domestic dispute at 2900 Mina-French Creek Road on June 18th. When deputies arrived, they encountered Bemis in the garage, holding a shotgun. One deputy took out his service weapon and told Bemis to drop his weapon. However, Bemis fired a shot into the air, and the deputy took cover behind a tree. According to OSI, the deputy — while behind the tree — repeatedly instructed Bemis to put the gun down.
