Valley Springs contractor sued for firing injured worker

SIOUX FALLS, S.D. (KELO) — A Valley Springs construction contractor is being sued by the U.S. Department of Labor for wrongfully firing an employee after they were injured.

The Occupational Safety and Health Administration (OSHA) said an investigation found an employee at Stone Hill Excavation LLC, and its successor Split Rock Sand & Gravel, was fired just two days after they reported second and third-degree burns from scalding water from a pressurized pipe.

Records from the Secretary of State’s office show the two businesses are owned by Spencer Schenk. Both are listed as “delinquent”, meaning there was no annual report filed.

In the lawsuit, the department asks the court to hold the company and its successor liable for illegal retaliation, reinstatement of the fired employee and the payback of wages, along with $100,000 in punitive damages…
