DA Walks Away As ‘Kill the Mayor’ Case Against Spurs Fan Collapses

Prosecutors have dropped the criminal case against Marcos Rene Olvera, the San Antonio man arrested last year after authorities said he posted “We need to kill the mayor” in an online Spurs fan forum. The charge, brought under Texas’ obstruction or retaliation statute, was dismissed in mid-March after prosecutors said the evidence was not strong enough to prove the elements of the offense. Olvera had faced a third-degree felony that could have carried prison time and fines if proved.

Court records show prosecutors dropped the case on March 19 because of “insufficient evidence,” according to the San Antonio Express-News. The Bexar County District Attorney’s Office told the paper it had “informed the mayor’s office that we could not proceed with the case” and said prosecutors evaluate threats against public officials carefully as they decide whether to file charges.

Police say the post appeared in an X forum called “Spurs Familia” during a heated discussion about the proposed Project Marvel development, and CPS Energy flagged the comment while monitoring social media, according to KSAT. Investigators with the Southwest Texas Fusion Center traced the account to Olvera, obtained a warrant and arrested him at his Northeast Side home, the outlet reported.

Legal context

Olvera was charged under Texas Penal Code §36.06 for obstruction or retaliation – a law that forbids threatening or harming someone in retaliation for their status as a public servant or for reporting a crime, per the statute text. That offense is generally a third-degree felony; under Texas law a third-degree felony carries a prison term of two to 10 years and a possible fine of up to $10,000, according to Justia.

Project Marvel backdrop

The alleged comment came amid debate over Project Marvel, the planned sports-and-entertainment district that includes a new Spurs arena; Bexar County voters approved funding measures connected to the plan in November 2025, according to election coverage by KSAT. The arena and associated public spending have been a frequent flashpoint in local politics and online forums…
