District Attorney’s Office finds use of force in November 2025 officer-involved shooting justified

COLORADO SPRINGS, Colo. (KKTV) – On Friday, Colorado’s 4th Judicial District Attorney’s Office completed its review of the November 13, 2025 officer-involved shooting on South Nevada Avenue. The report found that Colorado Springs Police Officer Austin Hornberger “used a degree of force which he reasonably believed to be necessary.”

Hornberger was responding to a call to a 911 dispatcher, with the caller stating that someone was trying to break into his room at the Nevada Flats Hotel.

According to the DAO’s report, two men and a woman walked into the hotel’s walkway. Joshua “Erick” Duncan was carrying what appeared to be an AK-47 rifle, which he pointed at Officer Hornberger. The weapon was later identified as a BB gun…
