What began as a child‑abuse investigation in Volusia County is now on track to become a homicide case, after deputies say an infant who had been in a vegetative state since 2023 was taken off life support Wednesday and later died while under hospice care at home.
Volusia County Sheriff Mike Chitwood said his office will now pursue a murder charge against the child’s father, 34‑year‑old Malcom Nelson of Orlando. Nelson was already facing an aggravated child‑abuse charge tied to the injuries that deputies say left the baby critically hurt three years ago.
Sheriff: Murder charge expected
In an update to local media, the Volusia Sheriff’s Office told WESH that the child “died while under hospice care at home” and that an upgraded charge will be considered after the autopsy is completed and the findings are forwarded to prosecutors. Chitwood said the sheriff’s office is working with medical examiners and the State Attorney’s Office as it prepares the case for a potential murder prosecution.
How the 2023 investigation began
Nelson was first arrested in October 2023 after deputies say the 3‑month‑old was rushed from an Ormond Beach home in late January 2023 in cardiac arrest. Doctors later found a brain bleed and other injuries that authorities say were consistent with abusive head trauma. Investigators say physicians also documented multiple fractures and signs of older, healing injuries.
