Tennessee law may block paralyzed Nashville man from suing over allegedly defective guardrail

NASHVILLE, Tenn. (WSMV) – Nearly a year after a guardrail pierced through Danny Freeman’s SUV, leaving him paralyzed from the chest down, the 28-year-old Nashville man says he is still trying to understand how a roadside safety device meant to save lives, changed his forever.

And now, Danny and his family say they are facing another devastating reality: a little-known Tennessee law could prevent them from recovering damages from the company that built the guardrail incorrectly.

“I’m not going to say there is no hope,” Danny said. “But it seems like with each day, it’s one thing after another trying to bring me back down.”…
