DENVER (KDVR) — It’s been over a year since a 10-year-old boy was struck by a vehicle and killed a few blocks from his house in Timnath, and on Monday, the trial against the driver accused of causing his death began in Larimer County court.
Oliver Stratton, or Ollie to his friends and family, was biking home from a friend’s house on Aug. 2, 2023, when he was hit and killed by a 53-year-old female driver accused of being distracted behind the wheel.

He is survived by his parents and three siblings, who have called for increased awareness surrounding distracted drivers. His ghost bike now lives inside the Stratton’s home after the town said it could not remain on the roadside any longer.
Amy Weiss, also of Timnath, is accused by prosecutors of texting while driving, which they say led to her hitting and killing the boy. They also accused her of deleting a text made at the time of the crash.
Weiss pled guilty to a charge of tampering with physical evidence on Dec. 6, 2023. The trial currently underway is to determine if she is guilty of careless driving resulting in death, a traffic offense. The charge is punishable by up to 90 days in jail and a fine of up to $300.
