Erie police arrested a Longmont man on Friday, saying he sold an Erie man the fentanyl that led to his overdose death last August, according to a release from the Boulder County District Attorney’s Office.
Augustus Smith, 39, was charged with one count of controlled substances distribution – fentanyl under four grams causing death, according to online court records.
Prosecuting people for dealing drugs that lead to someone’s death is fairly new in Colorado. A 2022 state law enacted harsher penalties for fentanyl sales that end in death.
