Baby girl’s ‘neck was broken’ in Florida ICU after doctors’ ‘excessive force’, parents allege in lawsuit

Florida parents are suing the hospital for allegedly covering up giving their baby a spinal cord injury that ultimately led to her death.

Gianna Lopera gave birth via emergency cesarean section on June 12, 2022, at the Orlando Health Winnie Palmer Hospital for Women & Babies. Her and Jahmiah Peets daughter, named Jahxy, was born at just 24 weeks.

The lawsuit said Jahxy was intubated and admitted to the NICU upon birth with no evidence of birth-related trauma . The family is being represented by Orlando law firm Rafferty Domnick Cunningham & Yaffa.

A neurosurgeon was called on June 27 due to concern over her upper extremities. An MRI two days later found that Jahxy’s neck had been broken.

The lawsuit stated: “This type of spinal cord injury could not occur without the use of excessive force when handling a newborn.
