Attorneys of Derek Rosa, teen accused of killing mom, ask judge to step down

The Hialeah teen who allegedly confessed to stabbing and killing his mother is now asking the judge handling his case to step down.

In a new court filing reviewed by NBC6, Derek Rosa claims he will not get a fair trial if Judge Richard Hersch stays on the bench, calling his conduct “hostile and biased.”

“I think the main one they cite is this is not a who-done-it, that Judge Hersch said this is not a who-done-it, so almost assuming that Derek Rosa is the person who committed the crime,” said criminal defense attorney Erick Cruz, who is not affiliated with Rosa’s case…
